自我国加入世界贸易组织以来,涉外案件逐年增多,对法庭口译的需求不断扩大。而我国目前尚未有关于法庭口译制度的立法,实际操作中更是无章可循,由此导致了一系列的法律问题。为了保障当事人的合法权益,确保法律程序的公正,维护我国司法的国际形象,法庭口译制度的建立已迫在眉睫。介绍美国、澳大利亚和日本等国家的法庭口译的立法和制度实践,并在此基础上提出我国建立法庭口译制度的一些构想。
Since China joined the World Trade Organization, the number of foreign-related cases has been increasing year by year, and the demand for court interpreters has been constantly expanding. At present, there is no legislation on the interpretation system of the court in our country, which is even more absent in practice. As a result, a series of legal problems have arisen. In order to protect the legitimate rights and interests of the parties, ensure the fairness of legal procedures and safeguard the international image of our judicial system, the establishment of court interpreting system is imminent. This article introduces the legislative and institutional practice of court interpreting in the United States, Australia and Japan. On the basis of this, it puts forward some ideas for establishing court interpreting system in our country.
