随着《食品安全法》、《广告法》的相继出台,产品代言连带责任被明文确定下来,对于虚假广告代言行为起到一定的威慑作用。然而,关于产品代言连带责任的争议却一直未间断,社会各界反应都比较热烈。本文从产品代言连带责任的归责基础入手,结合其归责原则的探讨,对其相关法律问题进行探析。
With the “Food Safety Law”, “Advertising Law” have been introduced, the product endorsement of the joint responsibility of the plainly determined, for the false advertising endorsement play a deterrent. However, the controversy over the joint and several liability of product endorsements has been uninterrupted and the response from all walks of life is rather enthusiastic. This article starts from the imputation basis of the joint and several liability of product endorsement, probes into its related legal problems with the discussion of its principle of imputation.
