欧盟基本法是欧盟法律体系中的宪法性法律。欧盟基本法的直接司法适用是通过欧盟基本法的规定和欧盟法院发展的一般法律原则确定的。欧盟法院对基本法的直接适用起着重要的保障作用。研究欧盟基本法的直接司法适用对构建中国宪法直接司法适用具有重要的意义。
The EU Basic Law is a constitutional law in the EU legal system. The direct judicial application of the EU’s basic law is determined by the provisions of the EU’s Basic Law and the general legal principles for the development of the EU Court. The EU Courts play an important role in safeguarding the direct application of the Basic Law. It is of great significance to study the direct judicial application of the EU’s basic law in order to establish the direct judicial application of the Chinese constitution.
