人民监督员制度是最高人民检察院为确保其职务犯罪侦查权和起诉权的正确行使,2003年秋季引入了民主监督制度,不仅体现了人民群众的基本要求,也加强全国人民代表大会的刚性监督力度。学理上宜探讨人民监督员制度化的必要性和价值目标,在检察权制衡下实现监督权同检察权的良性互动,同时国家应立足于中国司法制度实践,对人民监督员制度化路径展开研究,分析制度缺陷,从实践和理论上对制度予以完善。
The system of people’s supervisors is the proper exercise of the right of investigation and prosecutorial power of the crimes committed by the Supreme People’s Procuratorate. In the fall of 2003, the system of democratic supervision was introduced, which not only reflected the basic requirements of the masses but also strengthened the rigid supervision of the National People’s Congress .
