“法律必须被信仰,否则它将形同虚设。”在面对西方的没落与末世的现状,在应对西方法律传统出现的整体性危机,伯尔曼由此提出了整体主义法学的构想与广义的法观与之回应,在此基础上,伯尔曼形成了最广泛意义上的整体法律观。然而,在实证主义与工具主义法律观主导的中国语境下,伯尔曼的“法律信仰”常常被误解。本文正是以《法律与宗教》的“法律信仰”观为主题,正确梳理伯尔曼的广义法律观和“法律信仰”论,与当今中国法律观作比较研究,从而厘清“法律信仰”在中国语境的谬误并提出当下中国法律信仰的建构之路,即珍视中国传统文化,正识“法律信仰”。
