电子商务的兴起极大地便捷了我们的生活,然而同时也使网络犯罪大肆猖獗。其中,利用可网上支付信用卡实施犯罪的行为在形形色色的网络犯罪中占有不小的比例,给我国金融安全以及相关刑事立法带来了新的挑战。本文旨在通过分析我国利用网络实施信用卡犯罪的现状、特征、手段以及刑事立法方面存在的缺陷,以期从立法方面提出一些消除网络信用卡犯罪的防范措施。
The rise of e-commerce has greatly facilitated our lives, but at the same time has also made cybercrime rampant. Among them, the use of online payment of credit cards to commit crimes in various forms of cybercrime occupy a small proportion of our country’s financial security and related criminal legislation has brought new challenges. The purpose of this paper is to analyze the current situation, characteristics, means and criminal legislation of China’s use of the Internet to implement the existing defects in criminal legislation, with a view to putting forward some legislative measures to eliminate cyber-credit card crime prevention measures.
