公共卫生档案中对个人信息的泄露,可能造成相对人人格地位的降低和财产损失。文章列举了公共卫生档案中可能泄露个人信息的档案范围,着重讨论了保护个人隐私私密性的现实和法律意义,探讨现行《档案法》的立法疏露,提出相应立法建议。公共卫生档案管理,应从立法规范,档案管理机制、管理程序措施上完善,从提高档案及相关人员素养和法律意识入手,逐步改进对个人隐私的保护。
The disclosure of personal information in public health archives may result in the reduction of relative personal status and the loss of property. This article lists the scope of the files that may reveal personal information in the public health archives, and focuses on the practical and legal significance of protecting the privacy of individual privacy. It also discusses the current legislation on archives law and proposes corresponding legislative proposals. The management of public health archives should be perfected from the legislative norms, the archives management mechanism and the management procedures, and the protection of personal privacy should be gradually improved by improving the literacy and related personnel’s literacy and legal awareness.
