消费者利益是反垄断所要保护的重要利益之一,反垄断中的消费者利益既包括整体利益,也包括个体利益和集体利益。国家机关保护和消费者自我实现是维护消费者利益的两种基本方式。在反垄断实践中,消费者利益的实现存在许多困难如立法博弈的弱势、执法过程的缺位、司法救济的阻碍等。为了加强反垄断中消费者利益的保护,我国应当提高消费者的组织化程度,改善消费者在博弈中的地位,规范反垄断执法,促进消费者有效参与,完善反垄断诉讼制度,消除消费者维权障碍。
Consumer interest is one of the important interests to be protected by antitrust. The consumer interests in antitrust include both the overall interest as well as the individual and collective interests. The protection of state organs and the self-realization of consumers are two basic ways to safeguard the interests of consumers. In antitrust practice, there are many difficulties in the realization of consumer interests, such as the weakness of the legislative game, the absence of the law enforcement process, the obstruction of judicial relief and so on. In order to strengthen the protection of consumers ’interests in antitrust, China should improve the organization of consumers, improve consumers’ position in the game, standardize antitrust law enforcement, promote effective participation of consumers, improve antitrust litigation system and eliminate consumers Rights protection barriers.
