家庭暴力,特别是家庭中针对妇女的暴力,已成为侵犯妇女人身权利、影响家庭和睦和社会稳定之社会问题。人民法院作为预防和处理家庭暴力的最后一道防线,是家庭正义的维护者,更是家庭暴力防治工作的关键实施者,其在规制家庭暴力方面的作用是毋庸置疑的。鉴于新形势下家庭暴力暴露出的新问题,在现有的诉讼体系和制度下,法院在规制家暴作用的发挥上存在诸多问题和不足。基于包括家庭暴力案件在内的家事案件数量大量增加之现实需要,基于家庭暴力案件特殊性与复杂性之裁判需要,基于提高司法效率和深化司法改革之法治化进程需要,应当建立专门的家事法庭。
Domestic violence, especially violence against women in the family, has become a social problem that violates women’s personal rights and affects family harmony and social stability. As the last line of defense to prevent and deal with domestic violence, the people’s court is the defender of family justice and the key implementer of prevention and control of domestic violence. Its role in regulating domestic violence is beyond doubt. Given the new problems exposed by domestic violence in the new situation, under the existing litigation system and system, courts have many problems and deficiencies in regulating the use of domestic violence. Based on the actual need of a substantial increase in the number of family cases including cases of domestic violence, based on the specific needs of arbitration cases of domestic violence and the need of the rule of law in deepening judicial reform, it is necessary to establish a special family court .
