“用工”作为我国《劳动合同法》中的重要法律概念,迄今尚未得到学界的明确认知。本文对“用工”的内涵、构成要件及其法律意义提出了自己的认识,揭示出“用工事实”对形成和表达劳动合意的主导作用。着重分析了“用工”与书面劳动合同的法律效力及其配制关系,以及用工事实法律意义对未来劳动关系调整的制度诉求。最后提出我国《劳动合同法》书面形式强制规定的完善建议。
“Labor ” as China’s “Labor Contract Law” in the important legal concepts, so far has not been a clear understanding of the academic community. This article puts forward my own understanding of the connotation, constitutional elements and legal significance of “labor ”, and reveals the leading role of “employment fact ” in forming and expressing the labor agreement. Emphasis is placed on the legal validity of “employment ” and written labor contract and the relationship between them and the system requirements of adjusting the future labor relations in the legal meaning of employment. Finally, put forward our country’s “Labor Contract Law” written form mandatory provisions of the sound recommendations.
