2012年3月通过的新《刑事诉讼法》第210条明确规定:“适用简易程序审理公诉案件,人民检察院应当派员出席法庭。”简易程序公诉案件派员出庭,有利于检察机关履行法律监督职能,维护司法公正,同时也符合我国司法现状。本文在阐明简易程序公诉案件派员出庭必要性的基础上,对简易程序公诉案件出庭工作提出若干建议及立法设想,以期有助于该规定的完善与落实。 Article 210 of the new Code of Criminal Procedure, passed in March 2012, clearly stipulates that: “When applying for summary proceedings, public prosecution cases shall be dispatched to people’s procuratorates.” "Prosecution cases in summary proceedings are dispatched to court to facilitate prosecution performance Legal supervision functions, safeguarding judicial justice, but also in line with the status quo of our judiciary.
