一、问题的提出营业(Gewerbe,Unternehmen)是商法中的重要概念,它与营业转让、营业权保护等制度息息相关。和其他任何概念一样,脱离具体语境谈论“营业”无异于无的放矢,鉴于此,本文以德国法的文本为具体语境,旨在梳理营业概念在法律文本中的内涵和功能,希望能给我国有关“营业”的讨论提供参考借鉴。
First, the problem raised Business (Gewerbe, Unternehmen) is an important concept in the commercial law, it is with the business transfer, the protection of operating rights and other systems are closely related.
