There has been an explosion of labour contract disputes in China and the varieties have also been increasing with the social economic environment and labour market environment.As labour disputes have increased,the Chinese government has encouraged the channeling of these disputes into mediation and arbitration process,which can practically promote a favorable result toward the maintaining of a harmonious labour relations and therefore prevent open conflicts and collective actions in any forms which is contrary to the goal of building a harmonious society.To date,the research on the performance of labour arbitration indicates mixed results and is largely based on qualitative research.Consequently there is limited empirical evidence on which to assess how workers and employers rate their dispute resolution experience In this first study which uses quantitative survey data to discuss the effectiveness of the labour arbitration process in China,we examine the attitudes of the participants using a survey administered to disputants in the four local government Labour Dispute Arbitration Bureau(hereinafter referred to as LAB or LABs) in the city of Dalian,Liaoning Province,P.R.China.We examine the extent to which labour arbitration has met the needs of the parties.Qualitative interviews with disputants and lead arbitrators were used to triangulate survey findings.While some scholars have questioned the quality of the arbitration process,particularly its fairness for workers,our results based on empirical research in China indicates that both parties reported high levels of satisfaction with the arbitration process on a range of procedural due process and substantive due process measures.Results suggest that disputants are typically satisfied with the arbitration,believing that the arbitration is fair.The findings also show that the arbitration process seldom involve the participation of unions and is not influenced by other forces such as Guanxi.Data also indicates that the process is somewhat inclusive,with lesser educated workers,migrant workers,and women all participating.
