鉴于行政法的传统理论基础控制论和管理论从本质上存在着失衡,法学界人士在行政法传统理论基础上不断进行探索,寻求全新的行政法理论基础。在20世纪90年代,罗豪才教授提出了一种全新的理论平衡论,对整个法学界产生了十分重要的影响。文章从平衡论角度出发,浅析行政法律关系与监督行政法律关系之间的本质联系,并就对两者之间潜在的隐形矛盾进行探讨,提出自己的建议。
Given the traditional theoretical basis of administrative law, there is an inherent imbalance between cybernetics and management theory. Based on the traditional theory of administrative law, legal professionals continue to explore and seek a new theoretical basis of administrative law. In the 90s of the 20th century, Professor Luo Haocai put forward a new theory of balance theory, which has a very important influence on the whole legal circle. From the perspective of equilibrium theory, this article analyzes the essential relationship between administrative law and supervisory administrative law, and discusses the potential invisible contradictions between the two and puts forward my own suggestions.
