人民法院建立审判绩效考核制度的目的在于提高审判质量和效率,在尊重司法规律的前提下充分调动法院工作人员的积极性。长期以来,法院对审判绩效进行考核都会围绕案件数量来开展,但对于不同类型的案件,法官的工作量大小不一,若完全依照案件数来测算法官的工作量难免有失科学。尤其是破产案件的审判,纯粹是一种办案与办事的工作结合,以传统诉讼案件的评价体系去考核破产审判法官必然导致这些法官内心的失衡,久而久之就造成大家都不愿意办理破产案件的尴尬局面。本课题组立足于广州市中级人民法院(以下简称广州中院)破产审判实际,对破产审判绩效考核制度展开实证分析,并尝试进行制度的构建。
The purpose of the people’s court in setting up a trial performance appraisal system is to improve the quality and efficiency of the trial and fully mobilize the enthusiasm of the court staff under the premise of respecting the law of justice. For a long time, the court will carry out the examination on the performance of the trial around the number of cases. However, the workload of judges varies from one case to another. Judging the workload of a judge according to the number of cases is inevitably unscientific. In particular, the trial of bankruptcy cases is purely a combination of case handling and service work. Judging bankruptcy judges with the evaluation system of traditional litigation cases inevitably leads to an imbalance in the hearts of these judges, which in the course of time causes embarrassment to everyone who is not willing to handle bankruptcy cases situation. Based on the bankruptcy trial of Guangzhou Intermediate People’s Court (hereinafter referred to as Guangzhou Intermediate Court), the research group conducted an empirical analysis on the performance appraisal system of bankruptcy trial and attempted to establish the system.
