在相邻不动产关系权体系中,在“法定吃得饱”的相邻关系与“约定吃得好”的地役权之间存在一定的缝隙,即“法定吃得好”的法定役权。我国现行法律体系中对此主要是以行政手段进行处理,存在诸多弊端。基于公共利益和现实需要的考虑,应该由民法通过设定法定地役权来处理。比较法上类似于法定地役权的立法模式可资借鉴。《物权法》第162条的规定为法定地役权的设定预留了立法空间。未来我国物权法上的法定地役权应该以“物权一般法”与“物权特别法”的模式进行构建。可以通过修改《物权法》来规定“物权一般法”上的法定地役权,并完善现行“物权特别法”上的相关制度。

By modifying the “Property Law” to provide “legal general property rights ” statutory easement, and improve the current “property law ” on the relevant system.
