惩罚性赔偿在房地产预售领域中起了许多积极作用,但也存在许多不如意的地方。比如法定条件严苛、适用情形较少、具体赔偿标准模糊、惩罚性赔偿和损害赔偿并用易忽略、“已付房款”中具体包括的款项不明、举证责任分配不合理与无证预售适用惩罚性赔偿的条件不合理。产生这些问题的原因有三个,第一,预售房适用《消费者权益保护法》的不适应;第二,《关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》与《消费者权益保护法》存在差异;第三,相关制度尚未成熟。这些问题使得商品房预售的司法实践不符合公平与倾斜保护的价值观。
