将军事法基本原则划分为一般原则与特殊原则没有依据和意义。当前军事法学界对军事法的基本原则的表述不够科学严谨。军事法的基本原则应当包括维护国家军事利益原则、坚持党对军权的绝对领导原则、军地法治协调原则。
There is no basis and meaning for dividing the basic principle of military law into general principle and special principle. At present, the formulation of the basic principles of the military law by the military law circles is not rigorous enough in science. The basic principles of the military law should include the principle of safeguarding the national military interests, upholding the party’s absolute leadership over military power and the principle of coordination of military law and order.
