China's New Property Law and Implications for Hotel Development:An International Perspective

The new PRCs property law was finally passed on March 16,2007,and is effective with October 1,2007.The property law has been formulated in accordance with the PRC Constitution in order to identify the ownership of property,protect the property rights of owners,to safeguard the economic order of the socialist market and to maintain the fundamental economic system of the State.The property law demonstrates the determination of the Chinese government to better protect property rights. However, the effectiveness of the law remains to be seen.This research note will identify implications for hotel development in the PRC,as many current or future hotel owners feel that their expertise in hotel property development may be limited.With Chinas new property law being a most recent development,its practical implications may yet be speculative,and further research appears to be paramount,on how this policy will affect the determinants and level of hotel property investment in the PRC.
